"Human resources practitioners are called on with increased frequency to carry out investigations into a broad range of workplace issues. An investigation may be mandated by statute (for instance, the Occupational Health and Safety Act (workplace violence or harassment) or by the Human Rights Code (discrimination, harassment or poisoned work environment), by company policy or the common law (for instance, to determine if certain alleged misconduct occurred, whether it amounts to just cause and what, if any, disciplinary response is warranted). This course will consider the law applicable to workplace investigations from the receiving of the complaint, through investigation, witness interviews, report writing and communication. We will consider the law as well as the complex practical issues that arise in many workplace investigations and how to deal with them."
